Child support modifications in Missouri, part 2

On behalf of Stange Law Firm, PC posted in Child Support on Friday, December 18, 2015. Last time we were discussing the issue of modification of child support payments. This is a difficult process because the Missouri legislature has required that a court can only modify this child support obligation if there is proof of a substantial and continuing change that the current payment becomes unreasonable. For instance, if you lose your job, you income will drop and your ability to make these payments will be severely hampered. But the reason the statute requires the change be continuing is that most people cannot live very long

Fatherhood: Good for fathers and their children

On behalf of Stange Law Firm, PC posted in Fathers’ Rights on Friday, December 11, 2015. It takes two people to create a child. It shouldn’t be as shocking as it is to say, therefore, that it often takes two people (at least) to raise a child. Too often in family law cases, one parent is left out of the equation of raising a child. Fathers deserve every chance to play a role in their children’s lives. More courts, including in Missouri, are starting to better recognize that it is not only fair to assign joint custody between mothers and fathers, but it is

Creating a viable visitation plan

On behalf of Stange Law Firm, PC posted in Visitation on Friday, December 11, 2015. Visitation issues in divorce cases can be difficult. Visitation allows a non-custodial parent to have a reasonable amount of time with their child. Visitation rights are almost always granted unless there is showing of domestic violence or other abuse. And even if domestic violence has occurred, a Missouri court may find that visitation is in the best interests of the child. When developing a visitation schedule or any part of a parenting plan, it is important that the plan or schedule be realistic. You must be available for the times in

Know your Paternity rights

On behalf of Stange Law Firm, PC posted in Fathers’ Rights on Wednesday, December 9, 2015. Not too long ago, questions of paternity were something like gambling. You could take a blood test, but was hardly conclusive and if a mother denied the paternity of a man and the blood test did not match, his effort to be named as the father could be frustrated. Today, with the advent of DNA testing, the scientific accuracy of the test is now virtually 100 percent, and a mother’s protestations now have less force. For most men, fatherhood is very important, and the opportunity to be viewed as a

Why are court cases so complex?

On behalf of Stange Law Firm, PC posted in Child Custody on Friday, December 4, 2015.  The laws in Missouri governing divorce, paternity, child custody and child support can be difficult and confusing for non-attorneys. Statues are written in a very unnatural fashion, which can make them unclear. The situation may be made even more complex by the tendency to define a term or conduct by reference to another section of the Missouri Revised Statues. For instance, in section 452.375(2)(6), which deals with the factors a court should consider when determining what is in the best interests of the child, it mentions “domestic violence”

Leave for dads can help promote father’s rights

On behalf of Stange Law Firm, PC posted in Fathers’ Rights on Monday, November 30, 2015. Father’s rights are a complex issue. During a divorce, many judges in the St. Louis area probably still feel that raising children is “women’s work.” This can lead to the presumption that when it comes to custody matters, a mother will receive the custody of the children. For fathers, this can mean they must fight to obtain shared custody. And in some ways, the issue extends far beyond a Missouri family court, to other matters. One writer argues that providing better family leave benefits for fathers would help improve
